29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary was not provided.     On or about June 17, 2014 at the above addressed jobsite, employees installing a sewer line in an excavation were not protected from materials falling into the excavation, in that the spoil pile was less than two (2) feet from the edge of the excavation.       Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    On or about June 17, 2014, at the above addressed jobsite, an employee was digging for a waterline while in a trench that measured 5.6-5.9 feet in depth.  The trench was not provided with cave in protection, thereby exposing the employees to cave in hazards.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access.     On or about June 17, 2014 at the above addressed jobsite, the portable ladder used to access the trench did not extend at least three (3') feet above the upper landing surface, thereby exposing employees to the hazards associated with falls.       Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
