29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  The employer does not guard all the rotating parts of machines whose operation exposes employees to injury.    a. This violation was observed on or about June 25, 2014, in shop #1, located on the west end of the building, where employees were exposed to struck-by and caught-by hazards when operating a HYD-MECH S-25A horizontal band saw(SN 901943171), without the unused portion of the blade being guarded.  b. This violation was observed on or about June 25, 2014, in shop #2, located on the east end of the building, near bay door #3, where employees were exposed to struck-by and caught-by hazards when operating a Do All vertical band saw (SN 273-76228), without the unused portion of the blade being guarded.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that machine guarding is provided to protect the operator and other employees in the machine area.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s):  The employer does not guard the point of operation on machines whose operation exposes employees to injury.  a. This violation was observed on or about June 24, 2014, in Shop #1, located on the south wall of the building, where an employee was exposed to a struck-by hazard when operating a Wilton VSG Twenty brand drill press, Model 2035 without a point of operation guard.  b. This violation was observed on or about June 24, 2014, in Shop #2, located on the south wall of the building, between bay doors #2 and #3 where an employee was exposed to a struck-by hazard when operating unknown brand drill press without a point of operation guard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all the point of operations on all machines are guarded.

29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch:  The employer does not ensure that on all offhand grinding machines a tongue guard is installed and adjusted to one fourth inch or less from the abrasive wheel or that the distance between the wheel and the end of the safety guard peripheral member at the top of the abrasive wheel does not exceed one-fourth inch.  This violation occurred on or about June 24, 2014 in shop #2, located on the south wall near bay door #2, where employees were exposed to struck-by hazards when operating a 6 " Jet brand bench grinder without the tongue guards adjusted to within one quarter inch of the grinding wheel.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all abrasive wheel machinery are maintained to within one quarter inch of the grinding wheel.

29 CFR 1910.215(a)(4): Work rest(s) on grinding machinery were not adjusted closely to the wheel with a maximum opening of one eighth inch:  The employer does not ensure that the work rests on all offhand grinding machines are adjusted with a maximum opening of one-eighth inch. This violation was observed on or about June 24, 2014, in shop #2, located on the south wall near bay door #2, where employees were exposed to struck-by hazards when operating a Jet 6 inch bench grinder without adjusting the work rest to a maximum opening of one eighth inch between the rest and the wheel.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all abrasive wheel machinery are adjusted to a maximum opening of one eighth inch.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information.  The employer does not provide the update training according with the revised Hazard Communication Standard. This violation occurred on or about June 24, 2014, and at times prior thereto, when employees in the facility were required to handle hazardous chemicals without being trained on how to identify the hazard associated to those chemicals according with the revised Hazard Communication Standard.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information.
