OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer allowed a JLG aerial lift to be used as fall protection anchorage for employees working outside the lift basket creating the potential for the lift to tip over and/or the anchorage points to fail. a) Bethlehem Waste Water Treatment Plant, Digester Tank Dome Top -- On or about June 16, 2014, three employees, whose fall protection systems were anchored to the basket of a JLG aerial lift approximately 25 feet away, were performing roofing modifications to the dome shaped top of a Digester Tank more than six feet above grade. The employees were 1) utilizing the lift as fall protection anchorage which is outside of its design purposes of positioning personnel, their tools and equipment, 2) attaching more than one fall protection anchor to a single anchorage point on the lift, and 3) using the lift in its least stable forward position and not leveled. Among other feasible means of abatement, operators must only use this type of aerial lift as found in the JLG 800A/AJ Operator's Manual under 1) Section 1.3 General, which states, "Do not use the machine for any purpose other than positioning personal, their tools, and equipment", 2) Section 1.3, Trip and Fall Hazards, which states, Attach only one (1) lanyard per lanyard anchorage point, 3) Section 4, Machine Operation, Figure 4-1, which states Machine will upset in this direction if overloaded or operated on an out of level surface.
