29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a) At the Berchi Line, on or about 7/3/14: The employer did not administer a hearing conservation program for employees at the facility. An employee working as a line operator on the Berchi filling line was exposed to continuous noise at a level of 79.46% of the dose of the permissible exposure limit (PEL). The equivalent dBA for the 79.46% is approximately 88.3 dBA calculated as the 8 hour time weighted sound pressure level. Sampling was conducted for 358 minutes. A zero increment was included for the remaining 122 minutes of the workday.    Abatement certification must be submitted for this item.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a) On the Meligari Line, on or about 7/3/2014: A window panel cover was missing on the bottle filling and capping machine. Exposing employees to the point of operation and rotating parts.   b) On the Berchi Line, on or about 7/3/2014: A window panel cover was missing on the bottle filling and capping machine. Exposing employees to the point of operation and rotating parts.   Abatement certification must be submitted for this item.
