29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:        a) On or about 6/16/14 on the roof over the Texas deBrazil Steakhouse (Store # P101) and other adjacent  spaces in the building under renovation at 1 Walden Galleria, Cheektowaga, NY:  Employees accessed the roof by climbing up a fixed ladder from  the  2nd floor and exiting through a hatchway opening on the roof. The hatchway had a cover, but it was left open while employees were on the roof performing assigned duties.  Employees could walk directly into the hatchway floor opening  on the north  & west sides of the opening and fall approx.  23 ft.  No guardrails or other fall protection system was utilized.        NO ABATEMENT CERTIFICATION REQUIRED
