On or about June 17, 2014, a John Deere Backhoe that was utilized to assist with storm sewer installation was within ten feet of overhead electrical lines.

29 CFR 1926.34(c): "Maintenance and workmanship." Means of egress shall be continually maintained free of all obstructions or impediments to full instant use in the case of fire or other emergency. [58 FR 35083; June 30, 1993] On or about June 17, 2014 employees working within a trench with a depth greater than four feet were doing so without a safe means of egress.
