29 CFR 1926.352(d): Suitable fire extinguishing equipment was not immediately available in the work area(s) where welding, cutting, or heating was being performed: a) On or about 6/16/14 on the roof over the Texas deBrazil Steakhouse (Store # P101) and other adjacent spaces in the building under renovation at 1 Walden Galleria, Cheektowaga, NY: An employee used an Acetylene torch for brazing while repairing an HVAC unit. No fire extinguisher was present. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes: a) On or about 6/16/14 on the roof over the Texas deBrazil Steakhouse (Store # P101) and other adjacent spaces in the building under renovation at 1 Walden Galleria, Cheektowaga, NY: An employee accessed the roof by climbing up a fixed ladder from the 2nd floor and exiting through a hatchway opening on the roof. The employee also used a rope to hoist materials & equipment through the hatchway. The hatchway had a cover, but it was left open while employee(s) were on the roof repairing an HVAC unit. Employees could walk directly into the hatchway floor opening on the north & west sides of the opening and fall approx. 23 ft. No guardrails or other fall protection system was utilized. NO ABATEMENT CERTIFICATION REQUIRED
