OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to potential struck-by and crushed-by hazards: a) Backing Department: The Company did not conduct frequent or periodic inspections of the Budgit overhead hoist (Model 115843-12, Serial Number 25375). The hoist was used to transport 600 to 800 pound rolls of plastic backings. In the event of malfunction, employees could be exposed to struck-by and crushed-by hazards.
