29 CFR 1926.95(c): Personal protective equipment was not of safe design and construction for the work to be performed: On or about June 17, 2014 two climbers were removing existing rigid waveguide and access platforms from an obsolete communication tower. The tennis shoe style safety shoe worn by one of the climbers was flat soled and did not have a heel suitable for climbing on ladders and tower supports. This condition exposed workers to a fall from elevation hazard of 140 feet.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about June 17, 2014, the employer did not ensure that an employee was using fall protection equipment located at the 140 foot level of the communication tower, exposing employees to the hazards of falls. Employees were removing existing rigid waveguide and access platforms as part of tower renovation project.

29 CFR 1926.501(c): When employees were exposed to falling objects, the employer did not implement one of the following measures; -1 Erect toe boards, screens, or guardrail systems to prevent objects from falling from higher levels; or, -2 Erect a canopy structure; or -3 Barricade the area to which objects could fall, prevent employees from entering the barricaded area, and keep objects away from the edge of the higher level. On or about June 17, 2014 workers on ground level were exposed to the hazards of being struck by objects falling from the 140 foot level. The climbers above were using a band saw that was tethered, but not double tethered leaving it subject to falling during moves. There were construction materials that had been lifted into place using a cat head lift at the working level.
