29 CFR 1926.251(a)(1):   Rigging equipment for material handling shall be inspected prior to use on each shift and as necessary during its use to ensure that it is safe. Defective rigging equipment shall be removed from service:  -The nylon slings used to rig the 44' long "I" joists were not inspected prior to use in that they were torn, frayed and not in good working condition.

29 CFR 1926.451(g)(1)(vii):   For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:   Employees were standing on the mid-rail of a SkyJack ST11-3219 scissors lift while installing wood roof joists for a commercial structure, without other adequate means of fall protection. They were exposed to a potential fall hazard in excess of 10' from mid-rail to ground.

29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system:  -Employees were walking the exterior top plate of a commercial structure while setting wood roof joists while not using any type of fall protection system. Potential fall height was measured to be 11'.

29 CFR 1926.1404(m)(1)(i):   Manufacturer instructions, prohibitions, limitations, and specifications. Where these are unavailable, a registered professional engineer familiar with the type of equipment involved must approve, in writing, the selection and configuration of components:  The jib attachment that was attached to a JCB-532 rough terrain forklift being used to lift "I" joists had no lifting capacities or identification marks on it and it had not been inspected by an engineer prior to use to show that it was suitable for the job it was performing.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
