29 CFR 1926.200(i): During demolition activities, employees were not provided with safety instruction signs alerting them to the worksite hazards. The signs shall follow the requirements outlined in: American National Standards Institute (ANSI) Z35.1-1968, Specifications for Accident Prevention Signs, and Z35.2-1968, Specifications for Accident Prevention Tags, and contain rules which are additional to the rules prescribed in this section. The employer shall comply with ANSI Z35.1-1968 and Z35.2-1968 with respect to rules not specifically prescribed in this subpart. [44 FR 8577, Feb. 9, 1979; 44 FR 20940, Apr. 6, 1979, as amended at 58 FR 35173, June 30, 1993; 67 FR 57736, Sept. 12, 2002] a- 500 Route 38, Cherry Hill NJ: The employer did not provide safety instruction signs, at the worksite, which would provide employees with general instructions and safety measures to follow in order to avoid going near a building that was being demolished. As such, on or about 06/20/14, a company employee was struck and crushed by a block wall and corrugated roof (during demolition activities) while he was walking next to it. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): a- 500 Route 38, Cherry Hill NJ - closest to Route 38: On or about 06/20/14, company employees were exposed to cave in and crushing hazards when working in a trench (approximately 7 feet 6 inches deep), verified as having Type B soil, that contained sidewalls that were not sloped, benched, shored, or shielded to protect them. b- 500 Route 38, Cherry Hill NJ - closest to Mall: On or about 06/20/14, company employees were exposed to cave in and crushing hazards when working in an excavation (in excess of 6 feet deep), verified as having Type B soil, that contained sidewalls that were not benched, shored, or shielded to protect them. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19
