29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions had been taken to ensure their safety: (a) On or about June 18, 2014, for employees exposed to cave-in hazards while inspecting a sewer line approximately 8.5 feet deep without protective systems in place at or near North Sixth Street and East Broadway Avenue in Bismarck, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 314777509, Citation 1, Item 2A, and was affirmed as a final order on 2/7/11, with respect to a workplace located at 25th Street SW, Jamestown, ND.
