29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:    A.)  Wilkinson Excavating, Inc., 786 Azalea Drive, Meadville, PA  16335, on or about June 23, 2014 and times prior thereto:  An employee was working in an excavation to perform operations including, but not limited to, hand digging of soil.  The excavation was up to 7.7 feet deep.  Employee did not receive training on the 29 CFR 1926 Subpart P and workplace specific trenching and excavation training.

A.)  Wilkinson Excavating, Inc., 786 Azalea Drive, Meadville, PA  16335, on or about June 23, 2014 and times prior thereto:  An employee who utilizes ladders to access / egress excavations did not have ladder safety training.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    A.)  Wilkinson Excavating, Inc., 786 Azalea Drive, Meadville, PA  16335, on or about June 23, 2014 and times prior thereto:  An employee was working in an excavation to perform operations including, but not limited to, hand digging of soil.  The excavation was up to 7.7 feet deep and consisted of Type C soil.  The excavation's soil was not properly typed prior to the employee / company president entering the excavation. The competent person did not perform a manual soil test, including, but not limited to, a plasticity test, dry strength test or a thumb penetration test.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):    A.)  Wilkinson Excavating, Inc., 786 Azalea Drive, Meadville, PA  16335, on or about June 23, 2014 and times prior thereto:  An excavation collapsed while an employee was working in an excavation with the company president / competent person to perform operations including, but not limited to, hand digging of soil.  The excavation was up to 7.7 feet deep and consisted of Type C soil.  A means of cave-in protection, including, but not limited to, shoring, shielding, and/or sloping was not utilized while personnel were working in the excavation.
