OSH ACT of 1970 Section (5) (a) (1): Section 5(a) (1) of the Occupational Safety and Health Act of 1970:  The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of being caught-in, which are causing or likely to cause death or serious physical harm to employees.      a. This violation was observed on or about June 24, 2014, when employees at workstation TAKISAWA TC-3 were exposed to caught-in hazards while working or cleaning metal shavings on and around the rotating part of a chip conveyor without a guarded.      b. This violation was observed on or about June 24, 2014, when employees at workstation MORI SEIKI SL-15 were exposed to caught-in hazards while working or cleaning metal shavings on and around the rotating part of a chip conveyor without a guard.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to ensure that employees are not exposed to caught-in hazards.

This violation was observed on or about June 24, 2014 at the North wall of the manufacturing area where employees were exposed to struck-by hazards when operating a bench grinder without the side guard.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all bench grinder are equipped with the side guards.

Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that guards are installed on chains and sprockets.

29 CFR 1910.242(b): Compressed air used for cleaning purposes was not reduced to less than 30 p.s.i.    The employer does not ensure that compressed air used for cleaning is reduced to less than 30 psi. This violation was observed on or about June 24, 2014, when employees throughout the facility were exposed to struck-by hazards while blowing off equipment with compressed air without reducing the pressure to 30 p.s.i.    The Dimensional Machine Works, LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1910.242(b) which was contained in OSHA inspection number 313890493 Citation Number 1, Item Number 6 and was affirmed as a final order on 1/29/2010, with respect to a workplace located at 6930 San Antonio St, Houston, Texas 77040.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all compressed air used by employees to blow off equipment is reduced to less than 30 p.s.i.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.    The employer has not developed or implemented a written hazard communication program that describes how they comply with this standard regarding labels and other forms of warning, material safety data sheets, and employee information and training. This violation occurred on or about June 24, 2014, and at times prior thereto, where employees were exposed to inhalation and contact hazard while they were required to handle hazardous chemicals such as but not limited to DW40, Hydraulic oil, lubricants, EEZ FOAMY cutting fluid and other chemicals without a written hazard communication program had been developed and implemented. 29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s).     The employer does not maintain and make readily accessible copies of safety data sheets for each hazardous chemical in the workplace. This violation occurred on or about June 24, 2014, at the manufacturing area, where employees were exposed to inhalation and skin hazard while using chemicals such as, but not limited to, DW40, Hydraulic oil, lubricants, EEZ FOAMY cutting fluid and other chemicals, the safety data sheet for these chemicals were not maintained at the worksite.          The Dimensional Machine Works, LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1910.1200(g)(1), which was contained in OSHA inspection number 313890493 Citation Number 1, Item Number 8 and was affirmed as a final order on 1/29/2010, with respect to a workplace located at 6930 San Antonio St, Houston, Texas 77040. 29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  The employer does not ensure that employees required to operate forklifts are trained and evaluated. This violation occurred on or about June 24, 2014, and at times prior thereto, when employees in the facility were required to operate forklifts to move material without being trained and evaluated.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that they provide the employees training consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section.  The employer does not ensure that all chemicals in the workplace are labeled, tagged, or marked with the identity and hazard warning of those chemicals. This violation occurred on or about June 24, 2014, in the manufacturing area where chemicals in portable containers were used without a label or markings as to the chemicals identity or hazard warnings.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all chemical containers in the workplace are labeled with the identity and appropriate hazard warnings of the chemicals therein.

The employer does not provide the update training according with the revised Hazard Communication Standard. This violation occurred on or about June 24, 2014, and at times prior thereto, when employees in the facility were required to handle hazardous chemicals such as but not limited to DW40, Hydraulic oil, lubricants, EEZ FOAMY cutting fluid and other chemicals without being trained on how to identify the hazard associate to those chemicals according with the revised Hazard Communication Standard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees are trained on all hazards in their work area according with the revised Hazard Communication Standard.
