Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) An employee entered an excavation 6.6 feet deep, and excavated soil was placed within 2 feet of the west side of the excavation edge. Retaining devices were not utilized to prevent soil from falling or rolling into the excavation. Abatement certification and documentation is required for this item.

29 CFR 1926.651(h)(1): Employees worked in excavations in which there is accumulated water, or in excavations in which water is accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. a) An employee entered an excavation 6.6 feet deep with water accumulation from a broken irrigation line at its base, and protective measures had not been taken to prevent a potential cave-in. Abatement certification and documentation is required for this item. Owyhee Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(h)(1), which was contained in OSHA inspection number 943038.015, citation number 1, item number 1A, and was affirmed as a final order on November 4, 2013, with respect to a workplace located at the Corner Of N.
