Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards which were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with being crushed or struck by falling objects: Establishment: The commercial steel storage racks used to store pallets of items such as rope products and office items were not maintained to prevent collapse of the racks. Deficiencies included, but were not limited to: a) Shipping and Receiving Department: Bottom portions of the racks were damaged and rusted in areas such as the columns for the rack that stored office items. b) Rack Storage Area: A column of a center rack that stored boxes of rope product was not anchored to the floor and the bottom bracing was bent.
