29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   Portland Air National Guard Aircraft Weather Shelter Project-  (a) During access to and from the aircraft shelter's roof an employee was exposed to falls of approximately 30' 9" while leaving and entering the Genie GS-3246 scissor lift.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.       Aircraft Weather Shelters Portland Air National Guard Project -     (a) An employee was observed placing materials near the roofs unprotected edge and was exposed to falls of 20 - 30 feet to the surface below.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could neither free fall more than 6 feet (1.8 m), nor contact any lower level:     Or in the alternative     29 CFR 1926.502(e)(1): Positioning device systems were not rigged such that an employee could not free fall more than 2 feet (0.9 m):       Aircraft Weather Shelters Portland Air National Guard Project -    (a) While performing the installation of lightning strike protection systems on the roofs of eight aircraft weather shelters, workers were exposed to swing fall hazards and free fall hazards of 6 to 30 feet depending on their roof position.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.    Aircraft Weather Shelters Portland Air National Guard Project -    (a)Employees using and installing the Guardian Fall Protection system on roofs of eight aircraft shelters were unaware they were putting themselves into hazardous conditions when using this system as installed. This potentially exposed them to free fall distances greater than 6 feet and swing fall hazards.     (b)The foreman/competent person and safety manager failed to recognize and correct fall hazards associated with their site specific fall protection plan involving the Guardian Horizontal Lifeline System, rope lanyards, positioning devices, and fall protection harnesses. As installed and used, this system created hazardous conditions for employees by exceeding the maximum fall distance of six feet and exposure to swing fall hazards in the event of a fall. In addition, the foreman's statement not to tie off when leaving the scissor lift demonstrated a lack of knowledge of the hazards.       Note: Abatement certification and supporting documentation are required for these items.
