29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: a) Lot 189 Dilworthtown Dr.,Worthington Development, Smyrna, DE- An employee was observed using the top step of a stepladder to descend from the roof. Observed on or about 6/16/14. NOTE: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): . a) Lot 189 Dilworthtown Dr.,Worthington Development, Smyrna, DE- Employees were observed working at approximately 18 feet above ground level without fall protection. Observed on or about 6/16/14. De Miranda Adilio Rodriguez, dba De Miranda Construction was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 959891, citation number 1, item number 1a, and was affirmed as a final order on 5/9/2014, with respect to a workplace located at Stonewater Creek Development, Lot 457, Milford, DE 19963. NOTE: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
