29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a)Rip saw operator: On or about June 30, 2014 and at times prior thereto the employer exposed the employee to noise levels of 169.3% (equivalent to an 8 hour time weighted average (TWA) of 93.8 dBA) which is 1.693 times the permissible exposure limit of 100% (equivalent to an 8 hour TWA of 90 dBA) while operating the rip saw at the backside of the warehouse. Results were calculated for 313 minutes sampling period and included a zero increment for 167 minutes not sampled. The employer did not administer a continuing, effective hearing conservation program. b)Rip saw operator: On or about June 30, 2014 and at times prior thereto the employer exposed the employee to noise levels of 78.5% (equivalent to an 8 hour time weighted average (TWA) of 88.2 dBA) which is 1.57 times the Action Level of 50% (equivalent to an 8 hour TWA of 85 dBA) while operating the rip saw at the front side of the warehouse. Results were calculated for 319 minutes sampling period and included a zero increment for 161 minutes not sampled. The employer did not administer a continuing, effective hearing conservation program.
