29 CFR 1910.1200(a)(1): The employer did not effectively ensure that the information concerning the hazards of all chemicals to which the employees may be exposed to, was transmitted as accomplished by the means of the employer's comprehensive hazard communication programs including labeling and other forms of warning, material safety data sheets and employee training. On or about June 24, 2014, and at times prior thereto, the employer did not provide hazardous communication information to employees in areas where chemicals were present. Employees were exposed to chemical hazards from but not limited to acetic acid and ammonium bicarbonate.

29 CFR 1910.1200(g)(8): The employer did not ensure that material safety data sheets were readily accessible to the employees in their work area during each work shift: On or about June 24, 2014, and at times prior thereto, employees were required to work in and near areas where employees were exposed to chemical hazards from but not limited to acetic acid and ammonium bicarbonate. Access to Safety data sheets were not provided to temporary employees being supervised by the host employer.

29 CFR 1910.1200(h)(3): The employee training did not include the requirements of 29 CFR 1910.1200(h)(3)(i) through (h)(3)(iv): On or about June 24, 2014, and at times prior thereto, employees were not made aware of the location of safety data sheets or provided training by the employer. Chemicals including but not limited to acetic acid and ammonium bicarbonate were present in the work area exposing employees to corrosive and inhalation hazards.
