29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person: At this multi-family residential construction project, employees used a job-made personnel platform to elevate personnel and materials to above ground work locations on the structures under construction. The platform did not have adequate working load limits, gross weight determination and other safety equipment for personnel working from the platforms. The employees were exposed to falls greater than 10 feet.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: At this multi-family residential project, employees were working from a job-made box at a height of over 10 feet without adequate fall protection in place.
