OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. An employee was exposed to fall and caught in between hazards while working from inside of the bucket of a hydraulic excavator. Site: 43-45 East 22nd Street New York, NY On or about 6/26/14 a) Employees were riding in and working from the bucket of a hydraulic excavator of approximately 15 feet from the bucket to the ground below. Among other methods, feasible and acceptable abatement methods to correct this hazards are: 1. Prohibit employees to ride in and to work from the bucket of any hydraulic excavator. 2. Follow the Construction Industry Manufacturers Association (CIMA) recommendations for safe operating procedures contained in their manual. "Safety Manual for Users, Operators and Maintenance Personnel - Hydraulic Excavator.
