29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design.  On or about June 26, 2014, employees built and used a make-shift, wooden scaffolding platform that was not designed, constructed and loaded by a qualified person, exposing employees to the hazard of scaffold collapse and falls of approximately 20 feet high.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms where the entire platform was not attached to the fork.  On or about June 26, 2014, employees built and used a wooden scaffold platform that was not securely attached to the forks to prevent the platform from sliding off at approximately 20 feet high, exposing employees to a fall hazard.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  On or about June 26, 2014, an employee was framing the restaurant under construction using a rough terrain fork lift and a make shift scaffold platform at approximately 20 feet high without the employer having each employee trained to recognize scaffolding hazards, exposing the employee to a fall hazard.   Note: The training shall include the following areas, as applicable:  a)  Any electrical hazards, fall hazards and falling object hazards in the work area; b)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; c)  The proper use of the scaffold, and the proper handling of materials on the scaffold; d)  The maximum intended load and load-carrying capacities of the scaffolds used; and e)  Any other pertinent requirements of this subpart.

29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were made without the manufacturer's written approval: Note:  If such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals should have been changed accordingly.  On or about June 26, 2014, and at times prior thereto, the foreman and employees built a make-shift wooden, scaffold platform supported by a rough terrain forklift that was used to elevate personnel for construction work without getting manufacturer's approval. Employees were exposed to pivoting, slippage or tipping of the platform and forklift creating hazards of falling approximately 20 feet.
