OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of falling from an unguarded elevated platform:     On June 17, 2014, and at times prior thereto; platform:  During the installation of the support beams of the tent frame, employees were being elevated by using a Hyster powered industrial truck with a wooden pallet on the forks. The lack of using an approved personnel lifting device exposed the employees to a fall hazard of 20-30 feet to ground level; unsecured and sides unprotected. The employer did not ensure that additional precautions for the protection of employees were followed when the employees used a powered industrial lift truck to elevate personnel.     Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.25(d)(2)(xii): Tops of the ordinary types of stepladders were used as steps:    a) On June 17, 2014 and at times prior thereto; throughout site; employees were using the top step, of a step ladder, in order to install one the metal frames needed to erect the tent.       Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
