29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  On or about July 1, 2014 the employer had developed, but had not implemented, a written hazard communication program where three employees were exposed to chemicals including, but not limited to; new and used motor oil, brake fluids, anti-freeze, brake parts cleaner, brake fluid, transmission fluid, air conditioning refrigerant, and gasoline.

29 CFR 1910.1200(g)(1): The employer did not have a safety data sheet in the workplace for each hazardous chemical which they use.  On or about July 1, 2014 the employer did not maintain at the workplace a safety data sheet for gasoline where three employees were exposed to this chemical on a daily basis in the performance of general automotive repair and maintenance such as replacing fuel filters, clearing and replacing fuel lines, and purchasing gasoline and using it in law equipment at the site.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area.   On or about July 31, 2014 the employer did not provide hazard communication training for three mechanics who were exposed to hazardous chemicals including but not limited to; new and used motor oil, brake fluids, anti-freeze, brake parts cleaner, brake fluid, transmission fluid, air conditioning refrigerant, and gasoline.

29 CFR 1910.1001(f)(3)(i): During automotive brake and clutch inspection, disassembly, repair and assembly operations, the employer did not institute engineering controls and work practices to reduce employee exposure to materials containing asbestos using a negative pressure enclosure/HEPA vacuum system method or low pressure/wet cleaning method, which meets the detailed requirements set out in Appendix F to this section.  On or about July 1, 2014 the employer did not implement dust control measures for employees performing automotive brake inspection, disassembly, repair and assembly work.
