NOTE: Construction Reference: 1926.59 The requirements applicable to construction work under this section are identical to those set forth at � 1910.1200 of this chapter. 29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used: a) The employer did not provide effective information and training on the measures that employees could take to protect themselves during the cutting of paving brick, to protect themselves against exposures to hazardous crystalline silica. Employee(s) dry-cut paving bricks using two STIHL TS700 saws without using personal protective equipment or dust control methods.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. a) The employer did not ensure that worker(s) wore protective eye equipment when using the gas-powered STIHL TS700cut-off saws to cut paving bricks. None of the workers on site was observed wearing any eye protection even though it was available.
