One employee was exposed to falls of approximately 28 feet while conducting roof operations on an apartment building, and the employer did not maintain an accident prevention program which provided fall protection in accordance with the current requirements of 29 CFR 1926.20(b)(1).

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):                                                                      An employee installing roofing material on a roof while approximately 28 feet above a lower level were exposed to fall hazards and the employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     An employee was exposed to fall of approximately 28 feet to a lower level while installing roofing materials on a 6 in 12 pitch roof of an apartment building, and the employee was not protected by the use of guardrail systems, safety net systems, or personal fall arrest systems.
