29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) Worksite, 120 Secatogue Ave., Farmingdale, NY, east side of building- Employees used a stairway with no guardrails on the top platform approximately 13 feet above the ground below; on or about 7/2/14.     b)Worksite, 120 Secatogue Ave., Farmingdale, NY, west side of building- Employees used a stairway with no guardrails on the top platform approximately 13 feet above the ground below; on or about 7/2/14.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:    a) Worksite, 120 Secatogue Ave., Farmingdale, NY, east side of building- Employees were using a staircase without a stairrail on the unprotected sides to access and descend from the top level of the building; on or about 7/2/14.     b) Worksite, 120 Secatogue Ave., Farmingdale, NY, west side of building- Employees were using a staircase without a stairrail on the unprotected sides to access and descend from the top level of the building; on or about 7/2/14.     Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
