29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a)  Quality Stone & Masonry at 435 West Main, Aspen, CO 81611:  On or about July 2, 2014, the employer did not ensure that employees wore hard hats when walking and working on the ground under the patio that was 14.5 feet high, while other employees were setting flagstone on the perimeter of the patio.  In addition, an employee worked without a hard hat under a winch approximately 19 feet high, affixed to a horizontal member of a scaffold, used to lift buckets of cement for the masons on the elevated patio.  No toe boards or other means of containment for the tools and materials was in place.  Conditions exposed employees to head injury hazards from getting struck by falling tools and materials.

Conditions exposed employees to fall hazards of up to 14.5 feet high.

29 CFR 1926.501(b)(3): Each employee in a hoist area was not protected from falling 6 feet or more to lower levels by guardrail systems or personal fall arrest systems:  a)  Quality Stone & Masonry at 435 West Main, Aspen, CO 81611:  On or about July 2, 2014, the employer did not ensure that employees were protected from fall hazards while hoisting up cement to lay flagstone via a winch set on a horizontal member of scaffolding above head level, with the scaffolding based on the ground adjacent to the elevated patio.  Conditions exposed employees to fall hazards of up to 14.5 feet high.

29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches, whichever is less, were not equipped with at least one handrail:  (Note:  29 CFR 1926.1052(c)(7) applies when the top edge of a stairrail system also serves as a handrail.):    a)  Quality Stone & Masonry at 435 West Main, Aspen, CO 81611:  On or about July 2, 2014, the employer did not ensure that both the inside and outside stairs used to gain access to the second floor included handrails.  Condition exposed employees to fall hazards of up to 14.5 feet high.
