29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:    a) At the jobsite, on or about 11/13/2015:  The employer did not provide abatement certification for Citation 01, Items 001, 002a, 002b, Citation 02, Items 001a and 001b issued on December 19, 2014.  An abatement demand letter was sent to the employer on October 23, 2015.      Abatement documentation is required for this item.

29 CFR 1926.502(d)(6)(iii): A snaphook not of the locking type was engaged to a D-ring to which another snaphook or other connector is attached; such that unintentional disengagement could occur by the connected object being able to depress the snaphook keeper and release itself.    a)  At the jobsite, on the roof, on or about 7/2/14:  Employees were working on a 6:12 slope roof while using personal fall protection equipment where two connectors were attached to one anchor point d-ring creating the potential for side-loading and subsequent disengagement.        Abatement certification must be submitted for this item.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:    a)  At the jobsite, on the roof, on or about 7/2/14:  An employee was working on a 6:12 slope roof while using personal fall protection equipment where the location of the anchor point and the length of the lanyard ensured an 8 foot free-fall and contact with the side of the building in the event of a fall.    b)  At the jobsite, on the roof, on or about 7/2/14:  Employees were working on a 6:12 slope roof while using personal fall protection equipment where the location of the anchor point and the length of the lanyard would have ensured a greater than 6 foot free-fall and contact with the side of the building or with the ground (12 and 17 feet from ground).          Abatement certification must be submitted for this item.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.    a)  At the jobsite, on the roof, on or about 7/2/14:  The employer does not require each employee working 6 feet or greater above a lower level to be protected from fall hazards by guardrails or personal fall protection systems.  This violation was most recently observed at the worksite located at 3622 South East Townline Road in Marcellus, NY where employees working on a 6:12 slope roof with approximate ground to eave heights of 12 and 17 feet without fall protection.  To abate this violation, the employer musts ensure that it's employees are protected from falls when working at 6 feet or greater above lower levels.      The Roofing Guys was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.501(b)(13), which was contained in OSHA inspection number 942969, citation number 1, item number 1 and was affirmed as a final order on 3/13/14, with respect to a workplace located at 4436 Ashfield Terrace, Syracuse, NY.     The Roofing Guys was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.501(b)(13), which was contained in OSHA inspection number 921490, citation number 2, item number 1, and was affirmed as a final order on 9/19/14, with respect to a workplace located at 129 Iron Oak Circle, North Syracuse, NY.      Note:  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance with the requirements set forth in 29 CFR 1926.501(b)(13), including a description of how these steps protect its employees from fall hazards.

This violation was most recently observed at the worksite located at 3622 South East Townline Road in Marcellus, NY where employees working on a 6:12 slope roof with approximate ground to eave heights of 12 and 17 feet and with skylights approximately 10 feet to the lower level without fall protection.  To abate this violation, the employer musts ensure that it's employees are protected from falls when working at 6 feet or greater above lower levels.      b)  At the jobsite, on the roof, on or about 7/2/14:  The employer does not require each employee working 6 feet or greater above a lower level to be protected from fall hazards by guardrails or effective use of personal fall protection systems.  This violation was most recently observed at the worksite located at 3622 South East Townline Road in Marcellus, NY where employees working on a 6:12 slope roof with approximate ground to eave heights of 12 and 17 feet where two connections were made to a single D-ring anchor point.  To abate this violation, the employer musts ensure that it's employees are protected from falls when working at 6 feet or greater above lower levels.      c)  At the jobsite, on the roof, on or about 7/2/14:  The employer does not require each employee working 6 feet or greater above a lower level to be protected from fall hazards by guardrails or effective use of personal fall protection systems.
