29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.    a) Worksite, 120 Secatogue Ave., Farmingdale, NY- Employees were using a pneumatic nail gun to install plywood sheathing to a roof and were not wearing eye protection; on or about 7/2/14.    Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employees working from an aerial lift:    a) Worksite, 120 Secatogue Ave, Farmingdale, NY- Employees were performing work activities from a JLG model 600S aerial lift extended approximately 28 feet high. The employees were not protected or restrained from falling by the use of a body belt/harness and attached lanyard, thereby exposing employees to possible fall hazards and injuries; on or about 7/2/14.       Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) Worksite, 120 Secatogue Ave., Farmingdale, NY, roof of building- Two employees were installing sheathing to a residential roof approximately 40 feet above the ground and were not protected by complete fall protection; on or about 7/2/14.    b) Worksite, 120 Secatogue Ave., Farmingdale, NY, east side of building- Employees used a stairway with no guardrails on the top platform approximately 13 feet above the ground below; on or about 7/2/14.     Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
