29 CFR 1910.132(d)(1)(i): The employer did not assess the workplace to determine if hazards were present, or likely to be present, and did not select and have each affected employee use the types of Personal Protective Equipment (PPE) that would protect the affected employee from the hazards identified in the workplace hazard assessment: A) The employer inadequately assessed the hazards in the maintenance area by failing to recognize the chemical hazard associated with the use of 'Safety-Kleen 105 Solvent Recycled' by LeSaint Logistics Maintenance Staff. Employees are exposed to degreasing solvent splashing in their eyes when they clean truck parts.

29 CFR 1910.132(h)(1): Except as provided by paragraphs (h)(2) through (h)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, shall be provided by the employer at no cost to employees. a) LeSaint Logistics failed to provide Truck Shop Maintenance employees with chemical protective eyewear. Employees are exposed to chemical splash when they wash truck parts utilizing Safety-Kleen degreasing solvent.

29 CFR 1910.133(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a) LeSaint Logistics did not ensure that employees whom are exposed to chemical degreaser splash wear chemical goggles when using Safety-Kleen degreasing solvent to degrease truck parts as a requirement of their jobs.
