29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  For work performed at 1900 Rio Grande Street in Austin, Texas: On or about July 3, 2014 and at times prior thereto and thereafter, chemical hazard communication training provided to employees did not include information on the health hazards of chemicals associated with construction operations, and how to protect themselves from chemical exposures, including, but not limited to crystalline silica dust, Portland Cement, and styrene, exposing employees to the hazards of chemical inhalation.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them):   (a) For work performed at 1900 Rio Grande Street in Austin, Texas: On or about July 3, 2014 and at times prior thereto, inspections of the job site were inadequate in that the employer failed to identify and correct improper methods used by the tile contractor for cutting HardieBacker 500 Cement Board that were exposing employees to respirable crystalline silica. The contractor used powered tool(s) to cut HardieBacker 500 Cement Boards in lieu of manufacturer-recommended methods for installation, such as use of fiber cement shears for cutting or use of a score and snap method, exposing employees of the host employer and contractors to the hazards of crystalline silica inhalation.
