29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics shall be provided to the operator when: The operator has been involved in an accident or near-miss incident; a. Throughout Facility - On or about June 9, 2014, the employer failed to ensure refresher training was provided to a contract forklift operator who operates their forklift after he struck their employee, thereby exposing all of ITW employees to serious multiple injuries. b. Throughout Facility - On or about June 26, 2014, the employer failed to ensure refresher training was provided to a contract forklift operator after he experienced a near miss, thereby exposing all ITW employees to serious multiple injuries. c. Throughout Facility - On or about June 9, 2014, the employer failed to ensure that a powered industrial vehicle operator slowed down and sounded the horn at cross aisles and other locations where vision is obstructed, thereby resulting in an ITW employee being struck by a powered industrial vehicle.

29 CFR 1910.178(n)(4): The driver shall be required to slow down and sound the horn at cross aisles and other locations where vision is obstructed. If the load being carried obstructs forward view, the driver shall be required to travel with the load trailing. Throughout Facility - On or about June 9, 2014, the employer failed to ensure that a powered industrial vehicle operator slowed down and sounded the horn at cross aisles and other locations where vision is obstructed, thereby resulting in an ITW employee being struck by a powered industrial vehicle.
