29 CFR 1910.22(c): Covers and/or guardrails were not provided to protect personnel from the hazards of open pits, tanks, vats, ditches, etc.    a) A.T.A. Finishing Corporation did not provide guardrails or covers on finishing tanks to protect employees from fall hazards.  On or about July 9, 2014, employees were observed working on a platform which was only 17 inches below the opening of the tank.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

T. A. Finishing Corporation did not ensure that employees used appropriate eye protection when working around finishing tanks containing chemicals including sulfuric acid and sodium hydroxide. Anodizing tanks that did not have posted labels include, but are not limited to: 15% sulfuric acid, sodium hydroxide etch tank, and electrobrite aluminum chromate 190. Finishing Corporation did not determine the 8-hour time-weighted average exposure for chromium (VI).  Employees use Electrobrite Aluminum Chromate 190, a chromium (VI) containing compound, to anodize aluminum parts.    No abatement certification or documentation is required for this item.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:    a) A.T.A. Finishing Corporation did not provide training to employees by December 1, 2013 on the revised Safety Data Sheet format and content, as well as the new labeling elements as required by the revised hazard communication standard 29 CFR 1910.1200.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
