29 CFR 1910.106(d)(4)(i): "Construction." Inside storage rooms shall be constructed to meet the required fire-resistive rating for their use. Such construction shall comply with the test specifications set forth in Standard Methods of Fire Tests of Building Construction and Materials, NFPA 251-1969. Where an automatic sprinkler system is provided, the system shall be designed and installed in an acceptable manner. Openings to other rooms or buildings shall be provided with noncombustible liquid-tight raised sills or ramps at least 4 inches in height, or the floor in the storage area shall be at least 4 inches below the surrounding floor. Openings shall be provided with approved self-closing fire doors. The room shall be liquid-tight where the walls join the floor. A permissible alternate to the sill or ramp is an open-grated trench inside of the room which drains to a safe location.   a.  On or about July 9, 2014, in the touch up and repair area, was an inside room used to store flammable liquids.  The room was not liquid tight or equipped with raised sills or trenches to contain or redirect flammable liquids in the event of flammable liquid leak.  The storage room was not equipped with a self closing fire door.  The lack of appropriate fire protection inside the flammable storage room exposed employees to hazards associated with fires.

29 CFR 1910.106(d)(4)(iii): Wiring. Electrical wiring and equipment located in inside storage rooms used for flammable liquids, shall be approved under subpart S of this part for Class I, Division 2 Hazardous Locations;   a.  On or about July 9, 2014, in the touch up and repair area, was an inside flammable storage room used to store flammable liquids. The flammable storage room contained ordinary wiring and a gas fired hot water heater.  The inside storage room was not equipped with Class I, Division 2 rated electrical equipment thereby exposing employees to hazards associated with fires.

29 CFR 1910.106(d)(4)(iv): Ventilation. Every inside storage room shall be provided with either a gravity or a mechanical exhaust ventilation system. Such system shall be designed to provide for a complete change of air within the room at least six times per hour.  a.  On or about July 9, 2014, in the touch up and repair area, was an inside flammable storage room used to store flammable liquids.  The inside storage room was not equipped with a gravity or mechanical exhaust system.  The lack of exhaust provided for no air changes and thereby exposed employees to hazards associated with fires.

29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:   a.  On or about July 9, 2014, in the touch up and repair department, employees were required to work with chemicals including but not limited to, n-butyl acetate, toluene, and xylene.  The employer failed to perform an adequate hazard assessment for the work area to determine which hazards were present which necessitated the use of personal protective equipment.
