OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by or crushing hazard when operating forklifts without the use of a restraint device:   a) Maintenance shop:  On July 1, 2014 employees operated the Hyster powered industrial truck (forklift) without a serviceable operators seat or a seatbelt in place.

29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates and markings were in place and maintained in a legible condition:  a) Maintenance shop: On July 1, 2014 the data plate on the Hyster H40H and the information it provided was worn completely off, making it illegible. 29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training required by this paragraph (l):  a)  On July 1, 2014 the employer did not have a program in place to provide and /or ensure that each employee who operates a forklift had been formally trained in the fundamentals and inspection of the powered industrial truck, effects the operating environment has on the truck operation, safe operation, rules and practices, and operational training. 29 CFR 1904.29(b)(3): The employer did record each recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness had occurred:  a) On July 1, 2014 an injury which occurred on June 12, 2014 was not recorded on the 2014 injury log.  An employee suffered a laceration to the lower leg while operating a chainsaw.   Note) Abatement certification IS required for this item.
