29 CFR 1926.150(c)(1)(vi): A fire extinguisher, rated not less than 10B, was not provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas were being used on the jobsite: (a) Roof - Sam's Club, Silver Spring Commons, Mechanicsburg Pennsylvania - No fire extinguisher was provided for protection of employees working on the roof who used "Firestone Single-Ply LVOC Splice Wash" to clean the rubber roof material where they were installing seam sealing tape. The splice wash is a class 1B flammable liquid. The five workers each used it from three gallon metal containers at various areas on the roof and used electric heat irons to fuse seal the seams on or about July 7, 2014. No abatement certification or documentation required.

29 CFR 1910.1200(h)(3)(iv): The employer did not produce a hazard communication program that included an explanation of the labels received on shipped containers and the workplace labeling system used by their employer and the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: (a) Roof - Sam's Club, Silver Spring Commons, Mechanicsburg Pennsylvania - The employer did not provide employees with training on the revised hazard communication standard (HCS 2012) label elements and the new format and type of information on each section of the safety data sheets (SDSs) to ensure that when employees begin to see HCS 2012 compliant labels and SDSs in their workplace, employees understand how to use the labels and SDSs and access the information effectively on or about July 7, 2014. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
