OSH ACT of 1970 Section (5)(a)(1):       29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a) Building 3 - The employer did not guard the Finlay Hydraulic Rail Straightening Press to prevent employees from being struck by flying parts.  On or about April 29, 2014 an employee was struck by a spacer bar that was ejected from the press.      MODIFIED TO 5A1 PER ISA     Section 5(a)(l) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by  hazards of  parts or equipment  being ejected from a Hydraulic Press:    a)	Building 3 - On or about April 29, 2014, an employee was struck by a 3 inch x 3 inch spacer bar that ejected from a Finlay Hydraulic Rail Straightening Press. The employer did not ensure that the employee completely inserted or completely removed the spacer bar prior to operating the machine.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage were not separated from fuel gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire resistant rating of at lest one-half hour:    a) Building 3 - Oxygen tanks were observed stored less than 20 feet from LPG containers, on or about August 28, 2014.     No abatement certification or documentation required.

29 CFR 1910.305(c)(4): Snap switches mounted in boxes did not have faceplates installed so as to completely cover the opening and seat against the finished surface:     a) Break Room - A faceplate was not installed on an energized light switch exposing employees to electrical hazards, on or about July 9, 2014.    No abatement certification or documentation required.

29 CFR 1910.147(c)(6)(i)(C): Where lockout was used for energy control, the periodic inspection did not include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected:   a) Facility Wide - A review of employee responsibilities when locking out machines/equipment including but not limited to abrasive saws, welders, planer machine, stamping press, straightening press, CNC mill machine, etc., was not included in the periodic inspection, on or about August 28, 2014.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
