29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) In the shop - The employees were working with Sampson Miter Saw machine and Besten glass washing machine when they were exposed to continuous noise at 165.7%, 145.5% and 93.2% of the permissible daily exposure of 85 dBA (8 hour time weighted average) or an equivalent sound level of approximately 94 dBA, 93 dBA and 90 dBA during the 405 minutes sampling period on July 15, 2014 without implementation of an effective hearing conservation program. Exposure calculation included a zero increment for the 75 minutes not sampled. Employees were exposed to noise-induced hearing loss and becoming deaf.
