29 CFR 1915.12(a)(1): The employer did not ensure that sealed and non-ventilated spaces were visually inspected and tested by a competent person to determine the atmosphere's oxygen content prior to initial entry into the space by an employee: Barge SSB III, Port Rake Void: On or about July 3, 2014 and at times prior thereto, employee were allowed to enter a sealed and non-ventilated space prior to determining the atmosphere's oxygen content. This condition exposed employees to an oxygen-deficient atmosphere of 8-10% oxygen and resulted in an overnight hospitalization.

29 CFR 1915.73(b): When employees were working in the vicinity of flush manholes and other small openings of comparable size in the deck and other working surfaces, such openings were not suitably covered or guarded to a height of not less than 30 inches: Barge SSB III, Starboard Rake Void: On or about July 9, 2014 and at times prior thereto, the 20 X 18 inch flush manhole was left open and unguarded. This condition exposed employees to a fall hazard of approximately 10 feet.

29 CFR 1915.152(a): The employer did not provide or ensure each affected employee with the appropriate personal protective equipment (PPE) for the eyes, face, head, extremities, torso, and respiratory system, including protective clothing, protective barriers, personal fall protection equipment, and life saving equipment, meeting the applicable provisions of Subpart I, wherever employees were exposed to work activity hazards that required the use of PPE: Barge SSB III, Port Stern: On or about July 9, 2014 and at times prior thereto, employees adjusting lines on an unprotected edge over water did not utilize a U.S. Coast Guard-approved Personal Floatation Device (PFD). This condition exposed employees to drowning hazards.

29 CFR 1915.89(b): The employer did not establish and implement a written program and procedures for lockout and tags-plus systems to control hazardous energy during the servicing of any machinery, equipment, or system in shipyard employment: Barge SBB III, Winch House: On or about July 9, 2014 and at times prior thereto, during servicing of the anchor and ramp winch, the employer had not developed a written program for lockout and tags-plus system. This condition limited employee information to ensure proper de-energization has occurred when servicing the equipment.
