29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent.    On July 9, 2014, employees performing laundry services in the following instances were found in excess of the action level for noise and the employer did not include those employees in a continuing, effective hearing conservation program:    A) An employee was exposed to continuous and intermittent noise at 55.1% of the action level or an equivalent sound level of approximately 85.7 dBA during the 363 minute sample period.    B) An employee was exposed to continuous and intermittent noise at 54.2% of the action level or an equivalent sound level of approximately 85.6 dBA during the 348 minute sample period.
