Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being caught/ crushed by the elevator: a) The safety interlock switch on freight elevator car gate was jumped out by jamming a wad of paper between the switch contacts; resulting that the elevator can move with the inner car gate open. Employees riding the elevator can come in contact with the elevator shaft walls as the elevator moves, and be caught or crushed between the elevator car and the elevator shaft wall. Location: 327 W 36th Street, New York, N.Y. On or about 6/13/2014 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
