29 CFR 1926.501(b)(2)(ii): Each employee on a walking/working surface 6 feet (1.8 m) or more above a lower level where leading edges are under construction, but who was not engaged in the leading edge work, was not protected from falling by a guardrail system, safety net system, or personal fall arrest system. a) At 403 Kennedy Blvd., Pittston, PA 18640 (Fidelity Bank): Two employees were observed about 13 feet above ground level (on the roof of the Fidelity Bank) involved in wood blocking and framing for windows without a fall protection system. Employees were exposed to fall hazards on or about July 11, 2014. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS VIOLATION.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information. a) At 403 Kennedy Blvd., Pittston, PA 18640: The employer did not provide training on the revised Hazard Communication Standard (HCS) label elements and the new format and types of information on each section of safety data sheets (SDSs). Employees were exposed to chemicals such as Rust-Oleum marking paint and liquefied petroleum gas on or about July 11, 2014. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS VIOLATION.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (Construction Reference 1926.103) a) Fidelity Bank Building: Employees were wearing disposable Northern Safety (NS) 7210 NIOSH N95 particulate respirators while cutting dry-wall plasters and during other dust-generating tasks on the jobsite without receiving required respiratory protection information contained in Appendix D, on or about July 11, 2014. ABATEMENT CERTIFICATION IS REQUIRED FOR THIS VIOLATION.
