OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to crushing and/or drowning hazards due to potential roll-over while operating a riding mower on a steep embankment and without a rollover protection structure (ROPS): (a) On or about 7/3/14, an employee was exposed to a crushing and/or drowning hazard due to potential roll-over when operating a Bob-Cat Predator Pro Zero-Turn riding mower (model 942514J) to mow the grassy embankment of a retention pond at a slope of 21.3 degrees. b) An employee was exposed to a crushing hazard in the event of a roll over when operating a Bob-Cat Predator Pro Zero-Turn riding mower (model 942514J) without a rollover protection structure (ROPS).
