OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to fall hazards:  (a)Pavel & Associates Janitorial @ 1701 Wynkoop, Union Station Great Hall, Denver, CO 80202: On and before July 14th, 2014 an employee of Pavel & Associates Janitorial was exposed to a fall hazard of 20 feet while standing on the mid-rail of a Scissor Lift while polishing a clock in the Great Hall of the Union Station. The condition exposed an employee to a fall hazard of approximately 20 feet.

29 CFR 1926.454(a):  The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards:   (a)Pavel & Associates Janitorial, 1701 Wynkoop, Union Station Great Hall, Denver, CO 80202: On and before July 14th, 2014, the employer did not ensure his employees were provided with adequate training concerning the operating of a mobile scaffold. An employee was standing on the mid-rail of a scissor lift at approximately 20 feet without the use of fall protection.  This condition exposed the employee to a fall hazard of approximately 20 feet.       Abatement Note:  The training shall include the following elements at a minimum:     (1)The nature of any electrical hazards, fall hazards, and falling object hazards in the work area;     (2)The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used:     (3)The proper use of the scaffold, and the proper handling of materials on the scaffold;     (4)The maximum intended load and the load-carrying capacities of the scaffold used; and     (5)Any other pertinent requirements of this subpart.
