29 CFR 1910.146(d)(3)(iv): Under the permit space program, the employer did not develop and implement the means, procedures, and practices necessary for safe permit entry operations, including, but not limited to, purging, interting, flushing or ventilation the permit spaces as necessary to eliminate or control atmospheric hazards: a) In the parking lot of the Wal-Mart Distribution Center #6047, on or about July 14, 2014 - The employer did not develop and implement ventilation practices necessary for safe permit entry into a sewer line. An employee entered a sewer line to rehabilitate the precast side walls of a manhole.

29 CFR 1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location: a) In the parking lot of the Wal-Mart Distribution Center #6047, on or about July 14, 2014 - An employee used a DeWalt Rotary Hammer to rehabilitate the precast side walls of a manhole. The atmosphere in the manhole was hazardous and the DeWalt Rotary Hammer was not approved for use in hazardous atmospheres.
