29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) At the site, located in Manvel, Texas, on July 15, 2014, employees were exposed to struck-by hazards when working inside a trench measuring 11 feet by 5 feet 8 inches, with a depth of 4 feet 3 inches, where spoil piles were kept flush with the edge of the work area.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) At the site, located in Manvel, Texas, on July 15th, 2014, employees were exposed to caught in hazards when working inside a trench, 4 feet 3 inches in depth, and where a safe means of egress from the excavation was not available. R.D. Crumley & Company dba R.D. Crumley &Sons, Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 957720, citation number 1, item number 5 and was affirmed as a final order on 06/11/2014 , with respect to a workplace located at the corner of Medical Center Drive & Gulf Freeway, Webster, Texas 77598.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: a) At the site, where the competent person inspecting the excavation was not competent in that he could not type determine a safe means of egress from the excavation, could not determine if the benching system was adequate, did not know the safe position of spoil piles, and was not familiar with requirements of 29 CFR Subpart P. The R.D. Crumley & Company dba R.D. Crumley & Sons, Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 957720, citation number 1 , item number 6 and was affirmed as a final order on 06/11/2014 , with respect to a workplace located at the corner of Medical Center Blvd. & Gulf Freeway in Webster, Texas 77598.
