OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of falling which are causing or likely to cause death or serious physical harm to employees:  This violation occurred on or about July 15, 2014, at the job site where an employee was exposed to a fall hazard when working from the platform of an elevated forklift that did not have an operator in position to control the unit, or operate the controls.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that when elevating personnel, a trained operator is in position to control the truck of available to operate the controls.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:   The employer does not ensure that employees wear harnesses with lanyards attached when working from aerial lifts. This violation was observed on or about July 15, 2014, at the job site where an employee was exposed to an ejection and a fall hazard of approximately 15 feet when performing work from an elevated aerial lift without utilizing a body harness with a lanyard to protect him from being ejected.         Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees wear body harnesses with lanyards attached while employees work from elevated aerial lifts.

29 CFR 1926.602(c)(1)(viii)(A): The safety platform was not firmly secured to the lifting carriage and/or forks:   The employer does not firmly secure the work platform to the forks of the fork lift.  This violation was observed on or about July 15, 2014, at the job site where an employee was exposed to a fall hazard when working from an elevated platform on the forks of a fork lift without the platform being firmly secured to the forks.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all work platforms are firmly attached to the forks of forklifts.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level:   The employer does not protect each employee working on a scaffold more than 10 feet above a lower level from falling.  This violation was observed on or about July 15, 2014, at the job site where an employee was exposed to a fall hazard when working from a platform being lifted by a rough terrain fork lift without being protected from falling.     Viettex, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(ii), which was contained in OSHA inspection number 314779190, citation number 1 item number 1a and was affirmed as a final order on February 28, 2011, with a final abatement date of February 22, 2011, with respect to a workplace located at 1209 14th Street, Lubbock, TX 79401.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee working on a scaffold more than 10 feet above a lower level is protected from falling.
