OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to faulty equipment, such as the following, on or about 6/23/2014:    Instance Exposure to faulty equipment.    The Aerial Lift (Model # 50-5-IL-4H, Serial #92310-85R) was not properly inspected or tested, and did not have the required Dielectric testing performed annually as required by ANSI/SIA A92.2 - 2009 (8.2.2(2), exposing employee to faulty equipment.     The hazard was recognized by the employer, as evidenced by the inspection plaques attached to the equipment, which showed that the equipment has had previous inspections. On 6/23/2014, the employer stated that he had the equipment inspected and that it had passed the inspection.    Employees were exposed to faulty equipment hazards that could cause or was likely to cause death or serious physical harm.    There was feasible and useful method to correct the hazard by having the equipment properly maintained and inspected per the manufactures recommendations and the applicable ANSI Standards (ANSI/SIA A92.2).
